The collection and automated processing of personal data is aimed at maintaining the commercial relationship and performing tasks of information, training, advice, and other activities of Óptica La Mar S.L.

In cases where the user includes files with personal data on the servers of shared hosting, Óptica La Mar S.L. is not responsible for the user’s non-compliance with the GDPR.
Data retention in accordance with the LSSI
Óptica La Mar S.L. informs that, as a data hosting service provider and pursuant to the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the essential information to identify the origin of the hosted data and the time when the service began. The retention of these data does not affect the secrecy of communications and they may only be used within the framework of a criminal investigation or to safeguard public safety, being made available to judges and/or courts or the Ministry that so requires.
The communication of data to State Security Forces will be done in accordance with the provisions of the regulations on personal data protection.

Óptica La Mar S.L. holds all the rights to the content of the website https://www.opticalamar.com/ and the services offered therein, including intellectual property, industrial property, “know-how”, and other rights related to the contents of the website https://www.opticalamar.com/ and the services offered therein, as well as the programs necessary for its implementation and related information.
Reproduction, publication, and/or use not strictly private of the contents, total or partial, of the website https://www.opticalamar.com/ is not permitted without prior written consent.
Intellectual property of the software
The user must respect third-party programs made available by Óptica La Mar S.L., even if they are free and/or publicly available.
Óptica La Mar S.L. has the necessary exploitation and intellectual property rights to the software.
The user does not acquire any rights or licences by the contracted service, on the software necessary for the provision of the service, nor on the technical information of service monitoring, except for the rights and licences necessary for the fulfilment of the contracted services and only for the duration of the same.
For any action that exceeds the fulfilment of the contract, the user will need written authorisation from Óptica La Mar S.L. The user is prohibited from accessing, modifying, viewing the configuration, structure, and files of the servers owned by Óptica La Mar S.L., assuming civil and criminal liability for any incident that may occur on the servers and security systems as a direct consequence of a negligent or malicious action on their part.
Intellectual property of the hosted content
The use of the services provided by Óptica La Mar S.L. contrary to the legislation on intellectual property and in particular:
• The use that is contrary to Spanish laws or that infringes the rights of third parties. • The publication or transmission of any content that, in the opinion of Óptica La Mar S.L., is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory. • The use of cracks, serial numbers of programs, or any other content that infringes the intellectual property rights of third parties. • The collection and/or use of personal data of other users without their express consent or in violation of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. • The use of the domain’s mail server and email addresses for sending unwanted bulk emails.
The user has full responsibility for the content of their website, the information transmitted and stored, the hypertext links, the claims of third parties, and legal actions in reference to intellectual property, third-party rights, and child protection.
The user is responsible for the laws and regulations in force and the rules relating to the operation of the online service, electronic commerce, copyright, public order maintenance, as well as universal principles of internet use.
The user will indemnify Óptica La Mar S.L. for the expenses generated by the imputation of Óptica La Mar S.L. in any cause whose responsibility was attributable to the user, including legal fees and defence expenses, even in the case of a non-final judicial decision.
Protection of hosted information
Óptica La Mar S.L. makes backup copies of the contents hosted on its servers, however, it is not responsible for the loss or accidental deletion of data by the users. Similarly, it does not guarantee the full restoration of the data deleted by the users, as such data might have been deleted and/or modified during the time since the last backup.
The services offered, except for specific backup services, do not include the restoration of the contents kept in the backup copies made by Óptica La Mar S.L. when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always with the user’s prior acceptance.
The restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to Óptica La Mar S.L.
Commercial communications
In application of the LSSI, Óptica La Mar S.L. will not send advertising or promotional communications by email or other equivalent electronic means that have not been previously requested or expressly authorised by the recipients.
In the case of users with whom there is a prior contractual relationship, Óptica La Mar S.L. is authorised to send commercial communications regarding products or services of Óptica La Mar S.L. that are similar to those initially contracted with the client.
In any case, the user, after proving their identity, may request not to receive further commercial information through the Customer Service channels.
